CONTEXT ADDED BY ADMIN: END OF CONTEXT He is about 247 years old having attended law school with Oliver Wendell Holmes, Jr., but he doesn't look a day over 65--but I digress.
Anyway that position will probably devolve to Mrs. SG (who has done countless appeals) and me (I've done a few--but actually had oral argument in front of the 11th Circuit). I plan to use that UCC argument next time I have an appeal where the standard of review is "clearly erroneous".
"Hey Judges--yes I know that the standard of review is whether the judge's findings of fact are clearly erroneous but one time one of my law school professors mentioned that under the UCC certain contract provisions will not be enforced because of unconscionablity.... [crickets]"
Well maybe I won't. Because I am too young to retire.
But then again maybe I could become a glorified PE teacher Kinesiology professor. I hear its the latest thing to do with a law degree.
