about and the answer is NO, you are not somehow being treated less equal, at least in the legal sense.   You do have the right to marry, as the term is defined in most state laws, a member of the opposite sex, but for obvious reasons you choose not to do so.  I suppose you now do have the right to go to California and get married. 

The Federal government is not discriminating against you, b/c they do not administer marriage.   The state government is not discriminating b/c you do have the ability to marry a woman AND they are not allowing some gay couples to marry while denying you.   Your argument that somehow the preamble to the Declaration of Independence should somehow provide you the right to get married to your partner is a non-starter.   If you wanted to make a full faith and credit argument, you might be more persuasive.

For the record, I am in favor of civil unions, but ambivalent about gay marriages as I see both sides of the argument.
